Terms of Service

1. Acceptance of Terms

By accessing or using the WhereParcel API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

WhereParcel provides a unified REST API for global parcel tracking, aggregating tracking data from multiple carriers across different countries. The Service includes API access, dashboard, documentation, and related tools.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials, including API keys and secret keys. You are responsible for all activities that occur under your account.

4. API Usage and Rate Limits

Your use of the API is subject to the rate limits and quotas associated with your subscription plan. You agree not to:

  • Exceed your plan's rate limits or attempt to circumvent them
  • Share, sell, or redistribute your API keys
  • Use the Service for any unlawful purpose
  • Reverse engineer or attempt to extract the source code of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use automated tools to scrape or crawl the Service beyond API access

5. Subscription Plans and Payment

The Service offers free and paid subscription plans. Paid plans are billed on a recurring basis through our payment processor, Paddle. By subscribing to a paid plan, you authorize recurring charges at the applicable rate.

Plan features, rate limits, and pricing may change. We will provide reasonable notice before any pricing changes take effect for existing subscribers.

6. Service Level Agreement (SLA)

WhereParcel targets a monthly uptime of 98% for the API service. Uptime is measured as the percentage of time the API endpoints are available and responsive within a calendar month.

In the event that monthly uptime falls below 98%, paid subscribers may request a service credit. Credits are calculated as a pro-rata amount of your monthly subscription fee corresponding to the actual downtime experienced. For example, if the service is unavailable for 2% of a month beyond the allowed 2% downtime, you may receive a credit equal to that proportional amount of your monthly fee.

Service credits are the sole and exclusive remedy for any downtime or service unavailability. Credits are applied to future billing cycles and are not redeemable for cash. Credits must be requested within 30 days of the downtime event.

The SLA does not apply to: scheduled maintenance (announced at least 24 hours in advance), force majeure events, issues caused by your equipment or third-party services, or abuse/misuse of the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Tracking data processed through the API is sourced from publicly available carrier tracking systems. We do not store tracking results beyond our caching period.

8. Intellectual Property

The Service, including its API, documentation, design, and code, is the intellectual property of WhereParcel. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

9. Limitation of Liability

To the maximum extent permitted by law, WhereParcel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. WhereParcel does not guarantee the accuracy, completeness, or timeliness of tracking data, as this data is sourced from third-party carriers.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may cancel your subscription at any time through your dashboard. Upon cancellation, your access to paid features will continue until the end of your current billing period.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Jeju, Republic of Korea.
